A competing company attempted to copy a CTA member’s legal and registered products and image. This criminal act is called passing off.

Action by the CTA

The CTA initially acted as a mediator between the two parties. Great resistance was initially met, which triggered a thorough collection of evidence.

Results

The infringing competitor agreed to a reasonable timeframe to totally rebrand its company and products as well as pay damages to the CTA member.

The CTA provides heavy mediation leverage to its members on a regular basis and does resort to its legal team when complexity and risk increase.
